Privacy Policy

This policy explains how Cubic collects, uses, shares, and protects information when you use our websites, applications, and surveying services.

1. Scope

This Privacy Policy applies to Cubic websites, web and mobile applications, embedded order forms, and related products and services (collectively, the "Services"). It does not apply to a survey firm's independent privacy practices or to third-party services that have their own privacy policies.

Survey firms and other organizations use Cubic to manage work for their customers. When Cubic processes personal information on an organization's behalf, that organization controls the information and its use. Questions about that information should be directed to the organization first.

2. Information we collect

The information we collect depends on how you interact with the Services and may include:

  • Account and contact information, such as your name, email address, phone number, login details, role, professional credentials, and profile information.
  • Organization information, including firm details, team membership, service areas, settings, and billing contacts.
  • Surveying and project information, such as property addresses, parcel and legal descriptions, coordinates, project files, photos, field notes, schedules, quotes, orders, and customer or vendor details.
  • Transaction information, including invoices, payment status, transaction identifiers, and related records. Payment providers process complete card or bank account details on our behalf; Cubic does not store complete payment card numbers.
  • Communications, including messages, form submissions, support requests, feedback, and records of our correspondence.
  • Device, usage, and location information, such as browser and device type, IP address, identifiers, log data, pages and features used, approximate location, and precise location when you enable a location-based feature.
  • Cookie and measurement information, collected through cookies, pixels, local storage, analytics, and similar technologies. This may include interactions with the Services, session activity, referrals, and campaign performance.

We collect information from you, your organization, customers or partners that use our forms, connected services you choose to use, and automatically from your browser or device.

3. How we use information

We use information to:

  • Provide, operate, personalize, and maintain the Services.
  • Authenticate users and manage accounts, organizations, projects, orders, maps, quotes, invoices, and payments.
  • Communicate about transactions, product updates, support, security, and administrative matters.
  • Understand usage, measure campaigns, troubleshoot problems, and improve our products and user experience.
  • Detect, investigate, and prevent fraud, abuse, security incidents, and violations of our terms.
  • Comply with law, enforce agreements, protect rights and safety, and establish or defend legal claims.
  • Create aggregated or de-identified information that does not reasonably identify an individual.

4. How we share information

We may share information in the following circumstances:

  • Within your organization. Account administrators and authorized team members may access information connected to their organization and projects.
  • With customers and project participants. We share information as needed to coordinate a survey, process an order, provide a quote, or complete another workflow you request.
  • With service providers. Vendors help us provide authentication, hosting, databases, payments, email, maps, customer support, analytics, and measurement. These providers include services such as Clerk, Stripe, Neon, Vercel, Resend, Mapbox, PostHog, and Google.
  • For legal and safety reasons. We may disclose information when required by law or when we believe disclosure is necessary to protect Cubic, our users, or others.
  • During a business transaction. Information may be disclosed as part of a financing, acquisition, reorganization, sale of assets, or similar event.
  • At your direction. We may share information when you connect an integration, request a disclosure, or otherwise give us permission.

We do not sell personal information for money. Some privacy laws may define certain analytics or advertising disclosures as a "sale" or "sharing" even when no money is exchanged. You may contact us to exercise any applicable opt-out right.

No mobile information will be sold or shared with third parties for promotional or marketing purposes. Text messaging originator opt-in data and consent will not be shared with any third parties, except with service providers that support delivery of the messaging program.

5. Data retention

We retain personal information for as long as reasonably necessary to provide the Services, maintain business and transaction records, comply with legal obligations, resolve disputes, enforce agreements, and protect the Services. The retention period depends on the type and sensitivity of the information, why we use it, and applicable legal requirements. Information may remain in backups for a limited period after it is deleted from active systems.

6. Data security

We use administrative, technical, and organizational safeguards designed to protect personal information. No method of storage or transmission is completely secure, so we cannot guarantee absolute security. You are responsible for protecting your credentials and notifying us if you believe your account has been compromised.

7. Your choices and rights

Depending on where you live, you may have the right to access, correct, delete, or obtain a copy of personal information; to restrict or object to certain processing; to withdraw consent; or to opt out of certain sales, sharing, targeted advertising, or profiling. You may also have the right to appeal a decision on a privacy request and to receive equal service when you exercise a privacy right.

  • Update available account and organization information through the Services or your organization administrator.
  • Adjust browser controls to limit cookies and device settings to manage precise location permissions. Some features may not work as intended after these controls are changed.
  • Follow the unsubscribe instructions in optional marketing emails. We may still send transactional or administrative messages.
  • Email support@cubicsurveys.com to submit a privacy request.

We may need to verify your identity before completing a request. Authorized agents may submit requests where permitted by law, subject to verification of their authority. If we process your information for a Cubic customer, we may direct your request to that customer.

8. International data transfers

Cubic and its service providers may process information in the United States and other countries where privacy laws may differ from those in your location. Where required, we rely on appropriate legal mechanisms and safeguards for international transfers.

Where applicable, our legal bases for processing include performing a contract, pursuing legitimate interests such as operating and securing the Services, complying with legal obligations, and consent.

9. Children

The Services are intended for businesses and professionals and are not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe a child has provided personal information, please contact us so we can take appropriate action.

10. Changes to this policy

We may update this Privacy Policy as our Services or legal obligations change. We will post the updated policy here and revise the "Last updated" date. If changes are material, we may provide additional notice where required by law.
